(Fox News) A federal judge has ordered the IRS to explain “under oath” how the agency lost a trove of emails from the official at the heart of the Tea Party targeting scandal.
U.S. District Judge Emmet G. Sullivan gave the tax agency 30 days to file a declaration by an “appropriate official” to address the computer issues with ex-official Lois Lerner.
The decision came Thursday as part of a Freedom of Information Act lawsuit by conservative watchdog group Judicial Watch, which along with GOP lawmakers on Capitol Hill has questioned how the IRS lost the emails and, in some cases, had no apparent way to retrieve them.
The IRS lawyer argued that this might impeded the AG investigation, continuing the stonewalling. Judge Sullivan said “yeah, no, you’ll follow my directive, and also explain how the emails could be recovered with other methods”.
Meanwhile, Steve Stockman files motion to arrest Lois Lerner
Congressman Steve Stockman Thursday filed a resolution directing the House Sergeant-At-Arms to arrest former IRS Director of the Exempt Organizations Unit Lois Lerner on charges of contempt of Congress.
“Asking the Justice Department to prosecute Lois Lerner for admittedly illegal activity is a joke. The Obama administration will not prosecute the Obama administration. How much longer will the House allow itself to be mocked? It is up to this House to uphold the rule of law and hold accountable those who illegally targeted American citizens for simply having different ideas than the President,†said Stockman. “It’s time to for House to stop tacitly endorsing this administration’s illegal activity by refusing to hold him accountable. I expect Democrats to defend and even praise criminal activity. The question is whether Republican leadership will join them in mocking the House and breaking the law,†said Stockman.
Stockman hopes Nancy Pelosi, CNN, and The NY Times will be consistent, since they’ve all claimed the ability to arrest for contempt is within the House’s power. No worries, as none of them have mentioned this. In fact, other than Politico and The Hill, there are no major left leaning national news outlets which cover the story. Nor did the Big 3 cover it. I think we can all guess who this would be covered, along with the entire IRS scandal, had it occurred under a Republican president.

I have been in the civil cases as an expert and can tell you that judges don’t put up with losing evidence. Often that means that you go to jail until the hard drive starts to work.
What the Republicans need to do is shut down the government. But after what they did in Mississippi, I really don’t see a difference in the two groups.
