Carolyn McCarthy’s Gun Bill Sneakily Restrictive

Remember back to the earlier part of the week, when we were discussing what kind of handgun bill would be introduced by Carolyn McCarthy (D-NY), she had said she wanted something common sense, that wouldn’t get the NRA in her face. That notion went right out the window with her proposed legislation

The fiercest gun-control advocate in Congress released the text of a bill she plans to introduce next week that would outlaw high-capacity magazines like the one a gunman used to shoot 20 people in a matter of seconds in Arizona this weekend.

Rep. Carolyn McCarthy’s (D-N.Y.) bill also goes further than than the assault weapon ban that expired in 2004, outlawing the sale or transfer of clips that hold more than ten rounds, even those obtained before the law takes effect, according to a copy of the bill obtained by POLITICO.

So, she took an idea, that could have been popular politically, banning high capacity clips, and decided to go with one that bans all clips that hold more than 10 rounds. Which effectively bans the sale or transfer of some of the most popular handguns made, which have clips that hold more than 10 rounds. And this is retroactive, so, if you own clips that hold more than 10, you can keep them (but, they must be tagged with a unique number), but, they cannot be sold or transferred. So, the gun store can sell you a Smith & Wesson SW9VE 9mm Stainless, but, can’t include the clips or sell you the clips, which hold 16 rounds.

Why mention that gun? It is the #1 seller in 2009 for Bud’s Gun Shop, which released a top 20 list for 2009 sales. Of the top 20, 17 were handguns, and 9 held more than 10 rounds.

The bill carries a penalty of up to 10 years in prison.

I’m sure all the criminals who want to use high-capacity clips for mayhem will care.

“The only purpose for the existence of these devices is to be able to shoot as many people as possible as quickly as possible,” McCarthy wrote in a letter to her colleagues that accompanied the bill. “There is no reason that these devices should be available to the general public.”

And that is the wider view of Democrats on guns. And the legislation is a stealth attempt to ban the sale of many, many handguns, leaving store owners and manufacturers with stock they cannot sell here in the United States.

If it even makes it on to the House floor, it won’t pass, but, expect Democrats (not all of whom will vote for the legislation, surely) to slam Republicans for voting against it, and to use the Arizona tragedy as political fodder.

    I would much rather be shot at by someone with 30 rounds in his clip rather than 10. Really. The reason is called conservation of resources. So that the individual with only 10 rounds will make them count.

    Anyone else see that as excessive? Like being fined $250,000 for downloading a $0.99 song?

    Anyone see the videos showing how fast it is to switch out a clip to a Glock 9? A few seconds. One guy can do it in one second.

    I think it was on ACE’s site. Guy fires off 2 rounds, switches clips, fires off another 2 rounds all in a matter of a few seconds.

    yep, that proves the need for limited capacity clips… sure. yep. Just means a shooter will carry more clips.

    Saw on Drudge that as many people were killed in one MD county than in all of Afghanistan so far this year. Time to outlaw MD. How many people have been killed in Mexico? How come we haven’t outlawed Mexico?

    YES, outlaw Mexico! About 5 times as many folks have been killed there in 4 yrs, as in both Iraq & Afghanistan in over 10 years.
