(AP)Â Five immigrant mothers held in facilities with their children are seeking millions of dollars in damages from the U.S. government for what they contend is psychological and physical harm as a result of being detained, according to court papers filed Monday.
Andrew Free, a Nashville immigration lawyer representing the women, filed tort claims against the Department of Homeland Security, alleging the detained women and their children received inadequate medical care, suffered psychological trauma and in some cases were wrongfully imprisoned.
The tort includes Customs and Borders and ICE, both of which roll up to Obama.
But, seriously, they filed because they were detained because they are illegals.
But Free said that the reality of family detention is far different and that the government has “fallen below the standard of care that they owe to these detainees,” as well as violated their rights as asylum seekers by using detention as a deterrent.

We have an obligation to treat prisoners, detainees and arrestees humanely. We are the United States of America, not Saudi Arabia, Israel or North Korea.

If a Nanny abuses a child she/he should sue for being arrested?
If a Drug dealer’s stash is taken he should sue for being arrested?
I guess in somes eyes the concept of being arrested is inhumane when they break the law.

Neither word legislate nor regulate end in GATE. Are you against all legislation, regulation and litigation or only oppose acts with which you disagree?
Putting that aside, of course they can sue to determine whether they were legally detained and if the circumstances of their detention were legal and humane. Some times the courts are the only recourse to help balance differences in power. Courts are a symbol of civilization.
When we arrest/detain someone SUSPECTED of a crime we are obligated to treat the detainee humanely. Why? Because we’re America. And because the detainee is not being punished as they have not received due process and are innocent until proven guilty.
Of course Teach actually knows nothing of this case, or actually anything about immigration law.
Teach many of the women and children do NOT sneak into the USA. They enter and then immediately try to place themselves available for inspection. They know that by doing so they break NO LAW> It is not crossing the border itself which is breaking the law, it is failure to make yourself available for inspection
The proper thing to do is to send them back, and require that they apply to come here.
