Here’s what the Constitution says. Even a sometimes originalist like Scalia would appreciate the Constitutionality of Obama nominating a judge. There is no good argument against it. On the other hand, Senate Republicans are also within their Constitutional rights to refuse to confirm the nominee. Perhaps the Republicans would like to propose an Amendment to limit the ability of Presidents to make nominations to the first 3 years of a term.

You were doing good right up to that last sentence. Because, don’t forget, Democrats have worked very hard to block Republican nominees for many positions, especially under Bush.
Obama is welcome to nominate someone. The GOP Senate is welcome to tear that person and their sure to be hardcore leftist background apart, and vote against that person.

Again, anyone arguing that Obama shouldn’t nominate someone to fill the opening doesn’t understand the Constitution.
The majority Republicans do not have to confirm the nominee. The Republicans would PREFER that Obama not nominate anyone, since that would save them from the political fallout of leaving an opening in the Court for over a year. That’s why they are pre-emptively attacking Obama.
