Trump Administration’s “Public Charge” Rule Wins At Supreme Court

Realistically, should the United States Be bringing in vast amounts of immigrants who are unable to stand on their own two feet, ones who will immediately be living off the largess of the taxpayers? A goodly chunk of nations around the world require people to have usable skills and the ability to provide for themselves in order to immigrate. 5-4 Supreme Court allows rule to take effect that could reshape legal immigration

The Supreme Court in a 5-4 vote Monday cleared the way for the Trump administration to make it more difficult for low-income immigrants seeking to come to or trying to remain legally in the United States.

The so-called public charge rule, unveiled in August, impacts people who rely on public assistance, including most forms of Medicaid, food stamps and housing vouchers.

It made national headlines last summer when then-acting Director of US Citizenship and Immigration Services Ken Cuccinelli, in his defense of the rule, revised the iconic poem on the Statue of Liberty’s pedestal, saying: “Give me your tired and your poor who can stand on their own two feet and who will not become a public charge.”

Advocates and several states immediately opposed the rule, arguing that the changes would penalize immigrants who rely on temporary assistance from the government and impose costs on the states.

And that is exactly the point. When people were coming in to the US via Ellis Island, the government was not providing food stamps and welfare and healthcare and such: they had to earn their way. Why should the U.S. now be letting in people who will be essentially wards of the state? Forbes notes (in an article that is having a meltdown over this SCOTUS ruling)

Immigration analysts expect implementation of the public charge rule to be ruthless. An applicant would be denied permanent residence if a consular officer or immigration adjudicator, in effect, issues a prediction that an individual might use certain benefits for 12 months within a future 36-month period. U.S. District Judge George Daniels observed there is no precedent for this type of definition in the history of U.S. law.

The Migration Policy Institute concludes, “[N]early half of the U.S. noncitizen population could be at risk of a public-charge determination – up from the current 3%.” The technology startup Boundless estimates up to 200,000 young married couples could be at risk of not qualifying for a spousal green card under the regulation.

Should up to 50% of the people allowed in need public assistance? People who initially apply for citizenship already need to be able to stand on their own two feet to qualify. Why not the rest? This will cause a massive reduction in the number of refugees and such, as well as them bringing their family members over

(Fox News) The rule, announced by U.S. Citizenship and Immigration Services in August, defines a “public charge” as an immigrant who received one or more designated benefits for more than 12 months within a 36-month period.

Those benefits that would be designated included Supplemental Security Income (SSI), Temporary Assistance for Needy Families (TANF), as well as most forms of Medicaid and the Supplemental Nutrition Assistance Program (SNAP), commonly known as food stamps.

What most are forgetting about is that it could very impact those who are here illegally from being granted legal status, including DREAMers. Oops. Bummer.

A 2019 Urban Institute study found that people are already being deterred from applying for benefits for their U.S.-born children, fearing that it could harm their own immigration status. The study also found that 14 percent of nearly 2,000 adults who were born outside the U.S. or living with foreign-born family members have been dissuaded from participating in public benefit programs for fear it would impact their chances to obtain green cards, The Los Angeles Times reported last year.

The rule does not penalize applicants for benefits received by a family member, like a child who is a citizen. But many are scared and need convincing.

This is primarily talking about illegal aliens who had anchor babies.

Overall, shouldn’t the U.S. want to bring in people who can provide value, rather than be wards of the state? Shouldn’t our forcibly taken tax money be used to help Americans?

    Just Imagine everything Trump could have accomplished if every move he made were not opposed by activist judges in the lower courts.

      It’s almost as if Cons view trump as a king. Maybe it’s time to amend our Constitution to give unlimited power to the President, with Congress and the Courts in advisory roles. Flat tax, eliminate EPA, boost defense, ban abortion, make Evangelical Christianity the state religion, ban Islam, seal the borders except for bringing in workers for corporations, start shrinking the welfare state (SS, Medicare, Medicaid, SNAP, HUD, unemployment benefits) until it’s small enough to drown in a bathtub, start dismantling the “safety state” and reintroduce American freedom (get rid of air bag, seat belts, helmet, worker safety regulations etc). This whole representative gov’t thing has run its course, don’t you think. Maybe we have 8 years of total Con Man control. Do you think they’ll try to rig the system so that at the end of 8 yrs, the new elections will favor them, LOL?

      Not only the courts, but the REpublicans have stopped him as well. Then the Dems have been acting like an enemy from another country. It is apparent that the Dems party is coming apart. Bondi laid out a good case for what a criminal enterprise the Biden’s are. That likely would lay the foundation for charging Obama and Hilary, if we had a functioning law enforcement. Maybe Trump can get that going on his next term, if not then maybe in the third.

        Don’t count on it. Hillary really is above the law. She will never be charged with anything. If she is charged, she will never be prosecuted. If she is prosecuted, it will never go to court. If it does go to court, there is no possibility that a democrat will vote to convict her, and she will jury shop to ensure at least 75% of her jury are democrats. She and the Bidens and Obamas are untouchable. It is fun watching Democrat activist pointing and screeching at Trump about pretending to be above the law, when they obviously turn a blind eye to their own party Illuminati. There are so many other victories from the Trump administration though. Like Castro, eventually Hillary will die of natural causes and the world will get along just fine without her.

    Was watching a youtube video last night from a doctor in Wuhan. Smuggled out. In the video he said there are 49,000 beds in Wuhan hospitals. YET he showed pictures of the hallways and waiting room litered with sick and dead bodies.

    China is trying to hastily build TWO hospitals in two weeks. WHY?

    They are reporting 2000 sick. Its probably more like 50k to 100k sick.

    Videos are surfacing of TOWNS IN CHINA pour dump truck loads of dirt on their roads to prevent people from entering or leaving their town. Hardly the thing that 2000 sick people would inflict.

    Other videos of towns building brick walls in front of their roads.

    THE GOOD NEWS. This disease appears to only have about a 2.5 percent mortality rate vs. 9.5 percent with SARS.

    30K people die each year of the flu.in the USA alone.

        I’ll bet Dr Evil would love to hike the number, but, since you raise the issue (there really is a God!), how is it a nation whose medical system is not only totally socialized, but totally communized, lose control of an epidemic so quickly?

        According to Baghdadi Bunny, socialized medicine is the answer to our prayers.

        Yet here we have a situation where the “experts” (many of whom are in love with socialized medicine) tell us that we have a lot less to fear than the Chinese Reds should conavirus get here. We, with our antiquated, market-driven medical system.

          I suspect that the answer is in the infection rate before symptoms are visible and the natural inclination of workers to keep on doing their jobs despite a few sniffles. This really could happen anywhere. Especially true in cities where the possibility of getting infected caused already unknown infected people to scatter to escape the “hot zone” and thereby spreading it. Ask yourself, why the USA would send a charter airplane to airlift hundreds of Americans from that city and bring them back to the USA? Can’t the US State Department do math? Can’t the CDC help them figure the probability of one sick passenger passing the disease to everyone else on that flight and then scattering to the four winds through the continental air port system in the USA? It wouldn’t even take a great deal of imagination since it has already been the scenario in several major movies.

        How many people will become infected in MEXICO and Central and South America and see their only hope as swarming into the USA?

        As of sunday they were showing pictures of flights leaving WUHAN for the entire world…DESPITE KNOWING THIS VIRUS SPREADS WITHOUT SYMPTOMS BEING PRESENT. The worlds response. check for a fever.

        The fact you are showing a sincere lack of awareness of this virus tells me most of your science probably comes from google.

        I bet the left believes Trump started this to cover all his misdeeds he is being impeached for. No doubt Putin and Trump are responsible.

        I do not pretend to be a scientist or an educated man. I do however have a whole boat load of common sense. I can see where things are going and where they will end up.

        So I would caution people that the coronovirus lives on inert objects for up to 4 days. So remember that when you use anything in public. Do not touch your eyes, nose or mouth until you have thoroughly sanitized your hands.

        Remember it is infections with NO symptoms present.

        The Incubation period is 4-14 days. During which time you will feel fine.

        They are working on a Flu Immunization vaccine but will take at least 3 months to get it going and perhaps a year to have anything to give to the population.

        Remember 15 years later they STILL DO NOT HAVE A SARS VACCINE. So don’t hold your breath for this one.

        Estimates are around 300 million cold die. with a 2.5-3.0 percent mortality rate. Unless it mutates. China says it is showing signs of being able to Mutate.

        The real hope of the world is that it become Ebola like. So deadly it kills the hosts so quickly they cannot infect enough people to keep it in the runaway stage.

        This is not a democratic thing or a Republican thing. Sorry People Like Elwood have to make it personal.

          Interesting fact. Even al Jazeera is reporting on the coronavirus. Even the Middle East is taking precautions.

          In fact they are doing more reporting on it that CNN, MSNBC, CBS, ABC, FOX and NBC combined. Their pages and newscasts are full of it.

          I wonder what they know?

            No one has closed an airport yet or stopped permitting flights from China. How serious do you think they are really taking it?

            On the bright side. the international news networks tell us this same story every 4 years. last time it was Ebola. Before that SARS. before that, West Nile. None of them had the virulence or wide ranging effects that were predicted.

            We still don’t have a SARS vaccine because SARS is mostly harmless.
