12 Republican-led states sue President Biden over climate change order
Twelve Republican-led states Monday sued President Joe Biden over his first executive order aimed at climate change, alleging he lacked the constitutional authority to implement new rules about greenhouse gases.
The federal lawsuit, led by Republican Attorney General Eric Schmitt of Missouri, argues Biden violated the separation of powers clause in the Constitution because Congress, not the president, has the power to regulate.
On his first day in the White House, Biden signed Executive Order 13990, directing federal agencies to calculate the “social cost” of greenhouse gas pollution by estimating “monetized damages” to inform future federal regulations. This includes changes in net agricultural productivity, human health, property damage from increased flood risk and the value of ecosystem services.
But the 12 states that are plaintiffs say assigning such values is a “quintessentially legislative action that falls within Congress’s exclusive authority.” They also say the economic ramifications of the order will be disastrous.
“If the Executive Order stands, it will inflict hundreds of billions or trillions of dollars of damage to the U.S. economy for decades to come,” the suit reads. “It will destroy jobs, stifle energy production, strangle America’s energy independence, suppress agriculture, deter innovation, and impoverish working families. It undermines the sovereignty of the States and tears at the fabric of liberty.”
Republican state attorneys general from Arkansas, Arizona, Indiana, Kansas, Montana, Nebraska, Ohio, Oklahoma, South Carolina, Tennessee and Utah joined the suit.

Dozens of cases were heard – affidavits reviewed, lawyers heard, charges evalutated – and the judges rejected them all – but one. Are you insisting that there should have been jury trials?

Chatham County, Georgia, November 5. The Trump campaign filed a petition citing two Republican observers, who said they suspected a stack of 53 ballots received after the 7pm deadline on election day had been added to a different stack to be counted illegally. There was no other proof to back up their suspicions, and officials testified that the ballots in question had not, in fact, arrived after the deadline. “The court finds that there is no evidence that the ballots referenced in the petition were received after 7pm on election day,†Judge Bass said.
Judge Cynthia Stephens in Michigan’s Court of Claims, November 6. The Trump campaign asked the court to halt the counting of absentee ballots. As proof that misconduct was occurring, it provided an affidavit from one of its election observers, Jessica Connarn. She said an unnamed poll worker had told her the dates on some mail-in ballots were being changed, leading to invalid votes being counted. “This evidence is inadmissable as hearsay. The assertion that Connarn was informed by an unknown individual what ‘other hired poll workers at her table’ had been told is inadmissable hearsay within hearsay, and plaintiffs have provided no hearsay exception for either level of hearsay,†she said. The campaign’s complaint also alleged that Eric Ostegren, another observer, was “excluded†from the ballot review process. Judge Stephens said the claim was too vague. “The complaint does not specify when, where or by whom plaintiff was excluded. Nor does the complaint provide any details about why the alleged exclusion occurred,†she wrote.
Judge Timothy Kenny, Michigan, November 6. The Election Integrity Fund, a pro-Trump group, was seeking to stop election workers from curing mail-in ballots in Wayne County, a heavily Democratic area which encompasses the city of Detroit. It claimed Democratic Party inspectors were improperly duplicating ballots. “Plaintiffs do not offer any affidavits or special eyewitness evidence to substantiate their assertions,†Judge Kenny wrote. “Plaintiffs merely assert in their complaint, ‘Hundreds or thousands of ballots were duplicated solely by Democratic Party inspectors and then counted.’ Plaintiffs’ allegation is mere speculation. “The motion is based upon speculation and conjecture. Absent any evidence of an improper practice, the court cannot identify if this alleged violation occurred and, if it did, the frequency of such violations. “Plaintiffs have made only a claim but have offered no evidence to support their assertions.â€
Most cases were heard but dismissed for lack of credible evidence. A reasonable person would conclude that there was not significant fraud. A conspiracist would conclude there was a plot between multiple Red States, state and federal courts, the DNC, DOJ, FBI, media and the rest of the Deep State to cheat trump.
