Supreme Court to hear Trump ballot removal case out of Colorado
The U.S. Supreme Court will soon debate whether former President Donald Trump should be removed from Colorado’s primary ballot, the first of what could be several legal challenges by Trump to confront the nine justices.
At issue is whether Trump committed “insurrection” by inciting a crowd to storm the U.S. Capitol Jan. 6, 2021, and whether that would make him constitutionally ineligible to be re-elected president. That, in turn, could block him from appearing on a state primary ballot as a candidate for that office.
Oral arguments are scheduled for Thursday at 10 a.m. ET, and an expedited ruling could come within days or weeks.
The issues have never been tested at the nation’s highest court and are framed as both a constitutional and political fight with enormous stakes for public confidence in the judicial system and the already divisive electoral process.
What does the 14th Amendment state on the subject?
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

No. That is not the issue. The Supreme court is not a regular court that makes determinations of fact and law. They are specifically created and empowered to be above that.
Whether or not Trump committed insurrection is an argument over fact, and not something the Supreme court would rule on or care about.
The Supreme Court would rule on if the State of Colorado has the authority to exclude Trump for the reasons they gave, regardless of if the facts support that determination. Further, they could make a determination if the voters of Colorado are disenfranchised by the actions of the Colorado state government officials and whether voting rights were obstructed. They could further determine if the insurrection clause even applies to a President. They will not be making any determination if Trump committed insurrection because that accusation is not an issue in this case.
Colorado, a state-run by communists (democrats), has no compunction about disenfranchising anyone not on their team. Disenfranchisement always comes when you have dictatorships running the show. We all know that democrats blame on us what they themselves are doing and their current March toward fascism is no exception.

SCOTUS is a political body regardless of what we want to believe. How else could we have 5-4 decisions? We know, we know… Dems consider the conservative justices stupid and biased and Repubs consider the liberal justices to be corrupt and biased. They’re both kind of right.
In general, there is a political majority around a particular issue, e.g., Roe v Wade, and the justices justify their decision. The same with W being installed president in 2000 by a 5-4 vote.

OK, President Biden won 306 to 232, winning battleground states of Georgia (16), Arizona (11), Wisconsin (10) and Pennsylvania (20). Few other states were close, following a traditional Dem-Repub split.
In GA you needed was to find Trump 11,780 votes which would bring him to 248 EC votes. Georgia conducted 3 recounts and all found President Biden won. GA has a Republican Gov, House, Senate, Sec State and AG. Rudy G accused two election workers of voter fraud and a GA jury awarded the workers 100s of millions of dollars for Rudy’s lies.
Trump only needed 10,458 more AZ votes to win there, which would have brought him to 258. Maricopa County recounts did not change the outcome, nor did a “full forensic audit” by a Trump supporter’s organization.
PA was a bigger lift, as Mr Trump needed them to find him 80,556 more votes. That would have brought him to 278 and made him President Trump once more. PA conducted a risk-limiting audit and all counties also audited a sample of their votes as mandated by law. Biden won.
Trump needed 20,683 more votes in Wisconsin to capture their 10 EC votes. Dane County and Milwaukee County, the two largest counties also held recounts. Both confirmed that Biden had defeated Trump by more than 20,000 votes.
North Carolina was fairly close but Trump won, so no concerns.

If Congress determines that President Biden is guilty of treason, bribery and ‘other high crimes and misdemeanors’, the House can impeach him by a majority vote and the Senate can convict him on 2/3rd vote, at which time Biden will no longer be President. In addition, then-citizen Biden could be prosecuted for any crimes he may have committed.
If you were listening to any of the Supreme Court case this morning, one justice asked what would happen if a President took part or supported an insurrection while in office. Would he or she be immediately disqualified? What if he or she had lied about their residence and had only lived in the US for 13 years and 11 months?

Nevada Republicans finally caught on that it is profoundly stupid to allow your opponents to choose who your candidates are. Open primaries are stupid.
