The Supreme Court was concerned they were getting too powerful and wanted to return some power to the Executive Branch! The 6 textualists invented a new rule – The President has absolute immunity from prosecution for any official act (undefined). They have the presumption of immunity from prosecution for any private act (undefined). Amendment 31 describes Presidential Immunity in some detail.
Potential indictments for a private act goes to a lower court where their conclusion can be appealed… wait for it… all the way to the Trump Court!! Essentially this leaves impeachment as the only constraint on our Royal Presidents!
Those doing the illegal biddings of an immune president can still go to prison (Michael Cohen, Stephen Bannon, Mark Meadows, all those state level fraudulent elector schmucks etc).
Previously, the Trump Court legalized bribery of government officials, but only if the payment was delivered AFTER the desired action!!
And in Dobbs they overturned Roe v Wade. They recently overturned the Reagan era (1984) laws giving latitude for professional government agencies to enact policies (as authorized by Congress)! That 1984 decision was unanimous (only 2 of those justices were appointed by Dems!!). Over the years that far-left radical, Justice Antonin Scalia, was a champion of the 1984 Chevron vs decision!!!
It is rumored that Chief Justice Roberts was furious at the 3 justices who dissented – he wanted unanimity for making new law.
