It won’t pass the House. It might not pass the Senate. If, by some reason it did pass and made it to Biden’s desk and he signed it the Supreme Court would kill it. It is seriously deranged how much Trump has gotten into their heads, and really, isn’t it un-Constitutional to try and pass a law that targets exactly one person? If the law is more broad, well, Chuck should remember that it would leave Biden open to prosecution

Schumer pushing bill to strip Trump of court-granted immunity

Senate Majority Leader Chuck Schumer (D-N.Y.) announced Monday that he and other Senate Democrats will work to advance legislation to strip former President Trump of the immunity he was granted under a recent Supreme Court ruling protecting a president’s official acts from criminal prosecution.

Schumer, invoking Congress’s powers to regulate the courts, said Democrats are working on legislation to classify Trump’s efforts to subvert the results of the 2020 election as “unofficial acts” so they do not merit immunity from criminal prosecution under the high court’s recent 6-3 decision.

“They incorrectly declared that former President Trump enjoys broad immunity from criminal prosecution for actions he took while in office. They incorrectly declared that all future presidents are entitled to a breathtaking level of immunity so long as their conduct is ostensibly carried out in their official capacity as president,” Schumer said on the Senate floor.

Schumer said the court’s conservative justices had “effectively placed a crown on Donald Trump’s head,” putting him above the law and making him “in many ways untouchable.”

“I will work with my colleagues on legislation classifying Trump’s election subversion acts as unofficial acts not subject to immunity,” he announced. “We’re doing this because we believe that in America no president should be free to overturn an election against the will of the people, no matter what the conservative justices may believe.”

Hmm, sounds like Chuck is trying to subvert Democracy! by refusing to comply with the rulings of the Judicial Branch, to use Democrat language. Regulating the courts does not allow the Senate to disregard/change a Supreme Court ruling, nor strip Constitutionally guaranteed immunity. The only way to change immunity is with an Amendment, and, you can bet if the People and States are voting on it they’ll remove immunity from Congress.

This is just straight up lawfare. And an attempt at talking points, since it will never get a vote in the House. Though, it could be interesting if the House would take the bill and change it to specifically add on that Joe Biden is no immune for his time in office, and see how Democrats vote.

    It wouldn’t necessarily be unconstitutional as the Supreme Court largely left open what is an “official act”, which can be subject to statutory law.

        According to the Supreme Court ruling he has immunity for any official actions.

        If the DOJ has evidence for murders or other serious crimes that happened before Biden was President he could be in trouble.

        In the US only the President is above the law.

            Bullshit. As I say again and again, I agree with the findings of Roe v Wade. Abortion was permitted through the 1st trimester (where 93% of abortions are performed anyway!). Some restrictions are allowed in the 2nd trimester and the procedures can be banned in the 3rd trimester, except the state cannot choose to kill the woman. BTW dumbass, few women would carry a baby 9 mos and suddenly decide to get an abortion.

            Roe v Wade WAS the compromise. Now we have 12 red states that ban abortions for impregnated 10 yr old rape and incest victims!

        It was announced just yesterday that the official position of the RNC is that Abortion is an issue for the states to decide. There is no Republican position for national abortion policy. Doesn’t matter. Democrats will still run on “Republicans want national abortion ban”, just like they ran on “Republicans ant to take away Social Security”. While I am sure some Republicans want a national ban on abortions, most do not. Most are happy with just not using federal money to subsidize the big abortion lobby and their massive corporate profits.

        Personally, I am for abortion. I think abortions for black and Hispanic people should be free, paid for by donors to planned parenthood instead of using the money to lobby the government for money, and immigrants should have mandatory abortions to continue getting benefits. At least one abortion every three months starting when they enter the country. Even if they are not pregnant. Even the men.
        BTW, Abortion is already banned in every country on the planet. Every single one. There are broad differenced for when they allow it, but every country restricts the practice. No country has the “my body, my choice” extremist policy that is championed by the Democratic party in the USA. Even under ROW V Wade, abortions were “banned”. Since then many states have become less restrictive. Democrats should be thanking Trump for making wise Supreme Court decisions that advanced the abortion “rights” for so many women. The women who have benefitted the most are the ones living in the most liberal states. So what are they still bitching about?

            The Supreme Courts reach a consensus (even if 5-4) opinion and then search for justifications. In 1973 the Supremes found reproductive freedom as an unenumerated right as described in the 9th and 14th.

            It’s opinion bolstered with lawspeak. Much like same-sex marriage, The People will fix reproductive rights. Good laws trump the Supremes. Repubicun state politicos will work to stifle the will of the people but it will eventually catch up. States like Missouri, Kansas, Colorado, South Dakota, Florida and Kentucky (and doubtless others) will have statewide referenda and amendment votes to save women. Most blue states have laws protecting reproductive rights.

    Due process has nothing to do with privacy.

    The purpose of the BOR’s #10 is to insure that the states may adopt various laws that are not in the US Constitution. MA let’s people be forced to be vaccinated. State roads can establish speed limits. etc., etc, etc.

    The USSC merely reestablished the right of the states to have the right to govern themselves.

    Should we have a federal law that says 18 year olds be allowed to drink alcohol?
