Leftist Judge Says Musk Dismantling USAID Might Possibly Have Violated Constitution

This is a weird ruling, because it sounds more like a judge who is making a ruling without actually knowing what he’s talking about

A federal judge has rebuked Elon Musk and his Department of Government Efficiency for their efforts to dismantle the U.S. Agency for International Development, declaring that Musk’s effort to erase the agency likely violated the Constitution in “multiple ways.”

But the ruling Tuesday from U.S. District Judge Theodore Chuang appears to permit the Trump administration to ratify and maintain the draconian cuts — as long as they are ordered by USAID’s official leadership, rather than by Musk or his allies at DOGE.

Musk and DOGE “shall not take any action, or engage in any work, relating to the shutdown of USAID,” Chuang wrote in an injunction against the billionaire and his controversial cost-cutting initiative.

Chuang, an appointee of President Barack Obama, also ordered Musk and DOGE personnel to restore access to official computer systems for USAID employees, including those on administrative leave. The judge said Musk and DOGE can have no involvement in further staff reductions or contract cancellations.

So, he’s ordering all this on a “likely violated”? Where were judges like Chuang when all those Biden “czars”, such as John Kerry, were doing all sorts of things, like negotiating with other countries to give away US money. Of course, Trump, as the Final Boss of USAID, could simply order the executive order created agency ended….actually, he kind of did, because there is already an EO giving DOGE the power. Or Rubio could do it

The ultimate impact of the judge’s order remains unclear because it was directed solely at Musk and DOGE personnel, so it’s possible other Trump administration officials could simply reissue any orders initially given by DOGE members. Secretary of State Marco Rubio is currently acting as the head of USAID.

The effort was likely illegal for two reasons, the judge wrote. First, it appeared to violate the Constitution’s “appointments clause,” which says that government officials wielding significant power must be appointed by the president — and confirmed by the Senate — to offices established by Congress. Musk has not gone through that process. Second, the judge wrote, DOGE’s bid to effectively eliminate USAID appeared to violate laws passed by Congress that dictate the agency’s functions.

But, wait, Congress did not establish USAID. JFK did with an EO. Trump should simply end it with an EO. And then there’s this

Judge blocks Trump’s transgender military ban

A federal judge Tuesday blocked President Donald Trump’s executive order banning transgender people from enlisting or serving in the military.

U.S. District Judge Ana Reyes of Washington, D.C., ruled that the ban violates the equal protection clause because it discriminates based on transgender status and sex.

Reyes said the ban “is soaked in animus.”

“Its language is unabashedly demeaning, its policy stigmatizes transgender persons as inherently unfit, and its conclusions bear no relation to fact,” she wrote.

That’s a legal ruling from a federal judge? Sounds more like something from Media Matters or MSNBC. Trump should do like Biden, and just ignore the court. Or, simply take any and all trans in the military and assign them to scut work at a facility in the middle of nowhere. They would get no “affirming care”, no surgeries. Nothing. They won’t be around military grade weapons.

    In both cases, the judges are creating outcomes that they personally prefer without regard to the law or the facts.

    Musk and DOGE are not firing anyone. They whisper in the ear of the officially appointed and confirmed leaders of those agencies and those officially appointed and confirmed leaders take action. The judge cannot tell official government employees of the executive branch that they may not do their jobs that they were hired to do.

    The courts have recognized BROAD and significant authority to the President to operate the armed forces as he sees fit. That is how we got the integration of the armed forces AND the inclusion of trans people in the first place. What the president can include, a different president may exclude.

    Both of those judges are arguing that they prefer a different policy. No one elected them.

    USAID’s budget was $40 BILLION. Elon has that much in US federal contracts, and unlikely to do as much for America. Ending USAID makes neither strategic nor economic sense and further isolates America, which is Trump’s objective.

    Americans spent $150 BILLION on sports betting and $70 BILLION on lotteries last year.

    By comparison, Americans spend some $3,000 BILLION on housing expenses (mortgage, rent, utilities, insurance, upkeep) yearly, and increasing.

    Households spend an average of $10,000/yr of food (home and outside). We have about 130 million house holds so, carry the one… $1,300 BILLION on food, and increasing.

    Healthcare costs (direct, insurance, Medicare, Medicaid) average $15,000/person/year. That’s about $5,000 BILLION total per year.

    About 10% of Americans have a net worth of $1,000,000. 11% of Americans live in poverty.

    80% live in the middle!! Middle class income is defined as about $50,000 to $150,000/year.

    In 2022, the lowest quintile (bottom 20%) had an upper limit of $30,000/yr with a mean of $16,000. A single mom, working 40/week at $8/hr grosses $16,000 for her household.

    Will cutting a valuable %40 BILLION out of the budget help that mom? Of course not. The savings are intended to help the ‘makers’ like Musk, Bessent, Zuck, Gates, Trump, Bezos etc, etc, and so forth. In fact, MAGAts would cut any benefits the single mom might be receiving.

    The Federalist cult is huuge, with some 70,000 practicing attorney members. Their claimed beliefs are “checking federal power, protecting individual liberty and interpreting the Constitution according to its original meaning”, but goes far right of that, backing the notion that conservative presidents have superpowers.

        It is far more likely that Roberts is just a part of the DC establishment and want to be liked by everyone. He sees himself in the role of moderate peacemaker who can always find the middle ground. He doesn’t see the world as two sides at war with each other. He genuinely sees himself ad neutral and nonpartisan.

    Here’s a notion for the Prez…. move the offices of these pointless organizations to remote locations, like Pt. Barrow, Nome or boonies,North Dakota. Come to think of it, a case could be made for moving the capitol to someplace central and giving DC back to Maryland and Virginia.

      Virginia already got our share of DC back. The rest belongs to Maryland. If anything, we would like to give Alexandria, Arlington and fairfax to Maryland also.
