I do believe the state has a duty to safeguard inmates in custodial care and that American prisons largely fail in this. I also believe they fail because they don’t even try and don’t even care. It is a dark joke that prison rape is just part of the punishment of things that happen in prison, so don’t go there. This is a topic for broader prison reform, not for Trans “rights”. The trans MAN’s solution is to send him to a women’s prison, where HE would be at the top of the food chain and the big fish in the pond. Not really safeguarding the women inmates from him. It is a known tactic of people going to prison to claim to be trans so that they get an easier sentence in women’s prison.
A better solution would be doing a better job of segregating prison populations, categorized by levels of violence and type of crime. Perhaps trans people could be in their own jail, but then predatory men would claim that status to go prey on them. Taken to it’s extreme, you wind up with the entire prison population in solitary confinement. Modern prisons already have a great deal of capability for sorting and segregation. Mostly that ability goes unued.
Of course, if the death penalty were used more frequently, the number of really violent people in prison would diminish accordingly.
