This is a case tailor made for the Supreme Court to pick up quickly. Get the CDC lawyers in front of them within a week to explain their legal and Constitutional rational. Because the CDC, with certain approval from Dementia Joe, wants to do this through October 3rd

Biden administration, CDC announce new, targeted eviction ban for many renters

The Biden administration on Tuesday announced a new ban on evictions for many renters just days after the White House allowed a nationwide moratorium to expire on Saturday, infuriating progressive House Democrats who warned that millions of Americans could lose their homes.

As President Biden hinted at during his Tuesday afternoon news conference, officials at the Centers for Disease Control and Prevention drafted a new eviction moratorium aimed at protecting tenants in counties with “substantial and high levels of community transmission” of COVID-19. Over 90% of the U.S. population lives in the affected areas, sources told The Associated Press.

The two-month moratorium expires Oct. 3.

“The emergence of the delta variant has led to a rapid acceleration of community transmission in the United States, putting more Americans at increased risk, especially if they are unvaccinated,” CDC Director Dr. Rochelle Walensky said. “This moratorium is the right thing to do to keep people in their homes and out of congregate settings where COVID-19 spreads. It is imperative that public health authorities act quickly to mitigate such an increase of evictions, which could increase the likelihood of new spikes in SARS-CoV-2 transmission. Such mass evictions and the attendant public health consequences would be very difficult to reverse.”

Most people who want to work are back to work. They can pay their rent. Besides, as noted so many times, who pays the “rent” on the buildings? The bank has to be paid. Are the renters paying their cable, water, electricity, and sewer? How about their cell phone? They can find ways to cut that stuff and pay their rent. They’re going to have to pay it at some point in many cases.

Consideration of another pause came after immense pressure from progressive lawmakers for Biden to act quickly and extend the moratorium after the White House punted the issue to Congress last week, arguing their hands were tied by a recent Supreme Court ruling that implied most justices believed the CDC had exceeded its authority with the ban.

On Monday, White House press secretary Jen Psaki said Biden had asked the CDC on Sunday to consider extending the moratorium for 30 days, but said the agency had “been unable to find legal authority for a new, targeted eviction moratorium. Our team is redoubling efforts to identify all available legal authorities to provide necessary protections.”

So, they said no legal authority, and they went and did it anyhow?

House Democrats and the White House both shifted their attention over the weekend to expediting the distribution of $46 billion in rental assistance that Congress approved in December and March. Treasury data show that just $3 billion, or roughly 6.6% of the money, was doled out during the first half of the year.

If they’re passing out the funds, then it is fine. Why weren’t they?

The CDC can create laws now? Who knew!

And there’s the Progressive position in a nutshell: who the hell is going to do anything about Government drastically exceeding it’s lawful and Constitutional authority.

One surprising thing is that many landlords didn’t simply just not renew leases. That’s not eviction. And you may very see that start happening in the next few months, especially if Dems try and extend the moratorium past October.

    With Biden, the buck stops at other agencies.

    From his press conference announcing the eviction moratorium:

    Q Mr. President, we’re learning that your administration is about to announce a new partial eviction moratorium, COVID related. Can you tell us any more about that? And are you sure it’s going to pass Supreme Court muster?

    THE PRESIDENT: The answer is twofold. One, I’ve sought out constitutional scholars to determine what is the best possibility that would come from executive action, or the CDC’s judgment, what could they do that was most likely to pass muster, constitutionally.

    The bulk of the constitutional scholarship says that it’s not likely to pass constitutional muster. Number one. But there are several key scholars who think that it may and it’s worth the effort. But the present — you could not — the Court has already ruled on the present eviction moratorium.

    So I think what you’re going to see, and I — look, I want to make it clear: I told you I would not tell the Justice Department or the medical experts, the scientists what they should say or do. So I don’t want to get ahead.

    The CDC has to make the — I asked the CDC to go back and consider other options that may be available to them. You’re going to hear from them what those other options are.

    I have been informed they’re about to make a judgment as to potential other options. Whether that option will pass constitutional measure with this administration, I can’t tell you. I don’t know. There are a few scholars who say it will and others who say it’s not likely to.

    But, at a minimum, by the time it gets litigated, it will probably give some additional time while we’re getting that $45 billion out to people who are, in fact, behind in the rent and don’t have the money. That’s why it was passed in — in the act that we passed in the beginning of my administration, and it went to the states. . . .

    But in the meantime, I’ve asked, isn’t there any safety valve we can put in? And it’s the one I explained to you. Again, CDC will announce that and the details of exactly how it works. I’m not telling — I told them I want them to take a look. I didn’t tell them what they had to do.

    And my hope is, it’s going to be a new moratorium that in some way — and I’m not going to announce it now; I’ll let them announce it — in some way covers close to 90 percent of the American people who are renters. And so that’s all I can tell you now.

    Thank you very much.

    THE PRESIDENT: Because it’s a — (laughs) — let them explain that to you. Okay? I don’t want to get too far ahead.

    Biden is will to say that he knows the moratorium won’t pass legal analysis, the Sixth Circuit has already stopped the original moratorium, and yet there is no substantive difference between it and this moratorium.

    The left screamed when Trump needed to be impeached when he did not violate the Constitution, and now they are supporting Biden’s violation of the Constitution.

    The left hates that pesky document, because all the left has is hate.

      The Supreme Court immediately ruled on this and said it was blatantly UNCONSTITUTIONAL for the CDC to make this type of ruling.

      That is the job of the legislature. Nancy Pelosi thumbs her nose at the SC and refuses to have any kind of vote on the matter.

      Why? You have to remember that people are not working, they are mostly still getting huge checks from he government to stay home. To vote on this would once again prove the left is trying to crush the middle class.

      LANDLORDS on the other hand are more than a billionaire owning high rises. My bother for example has 5 rental properties and he barely makes a profit. He told me the other day he is going to have to file bankruptcy because he has had to pay the mortgages on 3 of them and had to do all the maintenance and pay the sewer and water bills not to mention make repairs, mow the lawns etc.

      Most landlords are once again SMALL BUSINESSES that are being decimated by the left.

      An Impeachable offense? Yes if you do something unconstitutional that would be the classic definition of an Impeachable offense. So I wonder when the house is given over to the right in 2022 which it should be based upon history. Will the right impeach Biden? I would think the last thing they want is for an incompetent K. Harris as president.

    What did Russia Don do:

    The moratorium was created by an executive order signed last August by President Donald Trump to protect tenants who missed monthly rent payments due to COVID-19 pandemic-related financial hardships from being forced out of their homes. The executive order was designed to end Dec. 31, 2020, but Congress extended it through January and the CDC extended it three additional times.

    But now it’s an unconstitutional and impeachable offense, LOL.

    We fully understand that the nuCon movement is all about chaos and anarchy in hopes of creating a white, christian authoritarian government, and tossing millions of poor people out on the street naturally appeals to them.

    What’s the answer? Unfortunately for hateful nuCons it’s more big gubmint to make landlords whole. Poor people just going back to work will never have the resources to pay a year’s worth of back rent.

        tRump signed an executive order halting evictions.
